Judges are now adjudicating cases where chatbots have crossed from tool into agent—providing actual legal counsel, fabricating case law, or shaping criminal intent—and the existing evidentiary and professional liability frameworks lack established rules for these scenarios. The problem is live. Defendants claim AI misled them, prosecutors must authenticate AI-generated materials, and responsibility remains unclear. The legal system's pace for updating doctrine cannot match AI's speed of adoption, leaving gaps where industry practice outpaces statute and precedent.
