Why Rewriting Copyright for AI Could Backfire on Creators
Source: Deeplinks
Publishers and creators pursuing lawsuits against AI companies are operating within existing copyright frameworks, but calls to rewrite those laws risk collateral damage—stricter protections designed to punish AI companies could also constrain legitimate uses like search, archiving, and smaller creators' ability to build on existing work. Training models on published work sits in an awkward legal gray zone where fair use claims clash with commercial intent, and legislators lack the technical literacy to solve it without creating worse problems. The question is whether courts actually test fair use doctrine rather than Congress passing broad restrictions that would entrench incumbent publishers while hurting the open internet.
